Terms and Conditions

1. Acceptance of Terms

By accessing and using MobiTech ERP, you accept these terms and conditions in full. If you disagree with any of these terms, please do not use the software. Continued use of the service implies acceptance of any future modifications to these terms.

2. License of Use

A non-exclusive, non-transferable and revocable license is granted to use MobiTech ERP according to the contracted subscription plan. The software is the intellectual property of MobiTech Consulting and is protected by applicable copyright laws in the European Union and international treaties. Copying, modification, distribution or reverse engineering of the software without express written authorization is prohibited.

3. Plans and Subscriptions

MobiTech ERP is offered under monthly or annual subscription models. Access to the software is conditional on timely payment of the corresponding subscription. In case of non-payment, MobiTech reserves the right to suspend access to the service after a grace period of 48 hours. Prices may be updated with a minimum notice of 30 days.

4. User Responsibilities

The user is responsible for: maintaining the confidentiality of access credentials; using the software only for legal and legitimate commercial purposes; not attempting to access systems, data or functionalities without authorization; complying with all applicable laws and regulations; performing regular backups of their data; and immediately reporting any unauthorized use of their account.

5. Limitation of Liability

MobiTech shall not be liable for indirect, incidental, special, consequential or punitive damages arising from the use or inability to use the software, including but not limited to loss of profits, data, use or commercial goodwill. MobiTech total liability shall not exceed the amount paid by the user in the last 12 months.

6. Limited Warranty

The software is provided "as is" and "as available". MobiTech does not guarantee that the software will be completely error-free, that it will operate uninterrupted, or that it will be suitable for a specific purpose.

7. Intellectual Property

All intellectual property rights over MobiTech ERP software, including source code, design, interfaces, documentation and associated materials, belong exclusively to MobiTech Consulting. Data entered by the user into the system is the property of the user.

8. Termination

MobiTech reserves the right to terminate or suspend the license if: the user violates these terms; fails to pay the subscription; uses the software fraudulently, illegally or in a way that is harmful to other users. Upon termination, the user may request data export within 30 days.

9. Applicable Law

These terms are governed by Spanish and European Union law. Any disputes shall be submitted to the competent courts of Spain.

10. Modifications

MobiTech may modify these terms at any time. Changes will be effective when published on the website and notified to registered users by email.
